Please read these Terms of Use carefully before using the Tarikhna mobile application operated by Octav.

Agreement to Terms

By accessing or using Tarikhna, you agree to be bound by these Terms of Use. If you disagree with any part of these terms, you may not access the Application.

Definitions

For the purposes of these Terms of Use:

• Application refers to Tarikhna, the mobile software application provided by the Company.
• Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Octav.
• Service refers to the Application.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

Use License

We grant you a personal, non-exclusive, non-transferable, limited license to use the Application on your personal mobile device, subject to these Terms of Use.

You agree not to:

• Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Application.
• Use the Application for any illegal purpose or in violation of any local, state, national, or international law.
• Attempt to gain unauthorized access to any portion of the Application or any other systems or networks connected to the Application.
• Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Application.
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the Application.
• Use the Application to harass, abuse, or harm another person or entity.
• Collect or store personal data about other users without their express permission.

Intellectual Property

The Application and its original content, features, and functionality are and will remain the exclusive property of Octav and its licensors. The Application is protected by copyright, trademark, and other laws of both Morocco and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Octav.

User Content

The Application may allow you to create, upload, or store content. You retain all rights to any content you submit, post or display on or through the Application. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such content in any and all media or distribution methods.

Prohibited Uses

You may not use the Application:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Application.

Disclaimer of Warranties

The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

The Company does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on the Application or otherwise relating to such materials or on any sites linked to the Application.

Limitation of Liability

In no event shall Octav, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Application.

Indemnification

You agree to defend, indemnify and hold harmless Octav and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Application, or your violation of these Terms of Use.

Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Use.

Upon termination, your right to use the Application will immediately cease. If you wish to terminate your use of the Application, you may simply discontinue using the Application.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Morocco, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Application.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Age Restrictions

The Application is not intended for children under the age of 13. By using the Application, you represent and warrant that you are at least 13 years of age. If you are under 13 years of age, you are not permitted to use the Application.
